Created in 1988, Municipality Week promotes municipal democracy and organization. It is an opportunity to recognize the role and work of municipalities, through the people who work in them, and the democratic life associated with them. A municipality provides services to its population, implements projects and organizes activities. It is at the heart of the daily lives of its citizens.<\/h3>\n\n\n\n

Do you know the legal framework to which a municipality must comply?<\/strong><\/h3>\n\n\n\n

The legal obligations of a municipality are numerous and cover the various aspects of local governance.<\/p>\n\n\n\n

In Quebec, a municipality must comply with provincial legislation<\/strong>, in particular the Cities and Towns Act<\/a>, the Municipal Powers Act<\/a>, the Act respecting land use planning and development<\/a>, and the regulations deriving therefrom. It must also comply with applicable federal laws<\/strong>, such as those governing environmental protection and human rights. In addition, municipal by-laws<\/strong> govern aspects specific to the community, as long as they comply with provincial and federal laws.<\/p>\n\n\n\n

<\/i> The Town of Sutton currently has dozens of municipal by-laws<\/a> that are essential to its effective operation, including by-laws emanating from the Brome-Missisquoi MRC.<\/mark><\/p>\n\n\n\n

A municipality’s legal framework applies to the following areas:<\/strong><\/p>\n\n\n\n

1. Governance and Administration<\/strong><\/h3>\n\n\n\n

The municipality must have an elected municipal council that adopts by-laws, votes the budget and oversees the general administration of the municipality. Council meetings must be open and minuted. Transparency in decision-making is mandatory.<\/p>\n\n\n\n

2. Land-use Planning and Urban Development<\/strong><\/h3>\n\n\n\n

The Act respecting land use planning and development <\/a>(LAU) requires municipalities to draw up and adopt a land use plan, which must respect the orientations of the MRC’s land use and development plan. The municipality must also adopt and enforce urban planning, zoning, subdivision and construction bylaws.<\/p>\n\n\n\n

3. Finances et taxation<\/strong><\/h3>\n\n\n\n

Every municipality must adopt a balanced budget each year and set municipal taxes to finance its services. It is also mandatory to produce an annual financial report, audited by an external auditor.<\/p>\n\n\n\n

4. Environment<\/strong><\/h3>\n\n\n\n

Municipalities must comply with provincial regulations and regional guidelines on waste management, including recycling and landfill management. They also have obligations regarding watercourse protection, including stormwater management and wetland protection.<\/p>\n\n\n\n

5. Municipal Service<\/strong>s<\/h3>\n\n\n\n

Municipalities are required to provide public safety services, including fire safety, which must meet provincial standards. They must also ensure the maintenance of their infrastructures such as roads, waterworks, sewers and municipal buildings.<\/p>\n\n\n\n

6. Ethics and Transparency<\/strong><\/h3>\n\n\n\n

Members of the municipal council and members of the municipal administration must abide by a code of ethics and professional conduct. The municipality must also respond to requests for access to information in accordance with the Act respecting access to documents held by public bodies and the protection of personal information<\/a>.<\/p>\n\n\n\n

7. Social Obligations<\/strong><\/h3>\n\n\n\n

Even small municipalities can be involved in managing or supporting social or affordable housing projects. They must also support various community initiatives.<\/p>\n\n\n\n

Note that municipalities have no strict legal obligation to offer recreational and cultural services. These services are offered according to needs and available resources, in order to promote the well-being of residents. The Municipal Powers Act<\/a> provides a framework for the services a municipality can offer in the areas of recreation, culture and community activities.<\/p>\n<\/blockquote>\n\n\n\n
