C&rsquo;est un peu comme si la ville disait \u00ab&nbsp;Attendez, avant que vous vendiez, je veux avoir la chance d&rsquo;acheter \u00e7a moi-m\u00eame !&nbsp;\u00bb.<\/p>\n\n\n\n<p>Ce nouveau pouvoir juridique a \u00e9t\u00e9 donn\u00e9 par le gouvernement du Qu\u00e9bec aux municipalit\u00e9s en juin 2022 dans le but de pr\u00e9server des lieux pour le bien-\u00eatre de la communaut\u00e9. Il est encadr\u00e9 par la <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/c-19\" target=\"_blank\" rel=\"noreferrer noopener\">Loi sur les cit\u00e9s et villes<\/a> (Art. 572) et ne peut \u00eatre utilis\u00e9 de fa\u00e7on arbitraire.<\/p>\n\n\n\n<p><a href=\"https:\/\/sutton.ca\/staging\/wp-content\/uploads\/2024\/02\/Reglement-334-droit-preemption-final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Le r\u00e8glement 334<\/a> de la Ville de Sutton vient pr\u00e9ciser les modalit\u00e9s du droit de pr\u00e9emption et les motifs pour lesquels la Ville voudrait acqu\u00e9rir un bien de mani\u00e8re prioritaire, par exemple pour soutenir le d\u00e9veloppement \u00e9conomique, conserver un milieu naturel, pr\u00e9server une infrastructure \u00e0 des fins communautaires ou autres, etc. (voir Art. 3 \u2013 Fins municipales).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Pourquoi c\u2019est important?<\/strong><\/h3>\n\n\n\n<p>Le droit de pr\u00e9emption permet aux villes d\u2019acqu\u00e9rir de mani\u00e8re prioritaire un immeuble strat\u00e9gique dans l\u2019objectif de d\u00e9cider de l\u2019utilisation d\u2019un bien immobilier en fonction des besoins de la collectivit\u00e9 et de mettre en valeur son patrimoine b\u00e2ti.<\/p>\n\n\n\n<p>C\u2019est un outil important pour contr\u00f4ler le d\u00e9veloppement du territoire et s&rsquo;assurer qu&rsquo;il est fait d\u2019une mani\u00e8re qui profite \u00e0 tout le monde.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Comment \u00e7a marche?<\/strong><\/h3>\n\n\n\n<p>Il faut savoir que le droit de pr\u00e9emption n&rsquo;est pas syst\u00e9matiquement exerc\u00e9. Il est utilis\u00e9 de mani\u00e8re s\u00e9lective, en fonction des objectifs d&rsquo;am\u00e9nagement du territoire et du budget disponible pour l&rsquo;acquisition de biens immobiliers.<\/p>\n\n\n\n<p>Concr\u00e8tement, la Ville doit adopter au pr\u00e9alable une r\u00e9solution pour d\u00e9signer l\u2019immeuble qu\u2019elle pourrait vouloir acqu\u00e9rir et envoyer un avis d\u2019assuj\u00e9tissement au propri\u00e9taire qui l\u2019obligera \u00e0 lui d\u00e9clarer toute offre d\u2019achat (voir Art. 4 \u2013 Assujettissement d\u2019un immeuble). Si un propri\u00e9taire souhaite vendre un immeuble assujetti situ\u00e9 sur le territoire de la Ville, celle-ci peut exercer son droit de pr\u00e9emption et acheter le bien \u00e0 la place de l&rsquo;acheteur initial, au m\u00eame co\u00fbt que celui propos\u00e9 par l\u2019acheteur.
